Cumplir 18 mientras aún eres un estudiante con estatus de “dependiente”

Este post tiene la intención de explicar un poco la situación de Nico. Seguramente alguno de mis lectores esta, estuvo o estará en la misma situación. Es un poco complicado y frustrante sobre todo para Nico, no solo porque no pueda empezar a estudiar porque para eso hay tiempo, sino por la sensación de impotencia.
Cuando uno viene como estudiante internacional, como yo, uno puedo estudiar y trabajar hasta 20 horas a la semana y tiempo completo cuando está en vacaciones. Pero Nico, no tiene ese status. Nico está como dependiente de estudiante internacional o trabajador extranjero. La palabra “dependiente“ es lo que hace que su estado migratorio sea tan complejo.
Y porque teniendo permiso de estudiante no puede trabajar?
Nico tiene permiso de estudiante. Igual que el mío. Pero, como él es dependiente, eso inmediatamente lo inhabilita para trabajar. En los permisos de estudio hay una anotación que pone inmigración que es donde dan o no permiso para trabajar. Nico no tiene esa anotación, como no la tiene no le dan el número de seguridad social y sin ese número no puede trabajar en ninguna parte.
Ahora, uno podría ir a Inmigración a solicitar el permiso de trabajo para Nico. Lo grave de eso es que inmediatamente él tenga un permiso de trabajo, deja de ser dependiente y eso lo desvincula del grupo familiar inmediatamente. Entonces tendría que empezar el proceso de inmigración el solo, y él no tiene ni siquiera el puntaje mínimo.
Manteniendo el grupo familiar
Al cumplir los 18 y aun no tener la residencia permanente (PR) hace más estresante la situación, porque ya lo ven como un adulto. Asumen que puede mantenerse solo y acceder a créditos y generalmente la gente no entiende porque no trabaja. Pero esta es nuestra realidad ahora. El por más grandecito que este aún necesita sus papas para el proceso migratorio y no hay vuelta de hoja.
Cualquier trámite de visado que él hago solo, es decir, por fuera del grupo familiar tendrá el mismo efecto y él se quedaría solo, sin suficientes puntos para empezar el proceso de Express Entry.
Así que por ahora tendremos que seguir teniendo paciencia, mirando como que podemos hacer para ayudarlo y esperar que pronto se nos dé el milagrito y podamos tener la tarjeta de residente permanente en nuestras manos.

Being 18 without a PR and SIN!
The intention of this post is to briefly explain Nico’s situation. I’m sure some of my readers where, are or will be in similar circumstances. This is somehow complex and frustrating especially for Nico. Not just because he is not able to start studying right after graduation, but also, because of the sense of helplessness.
When someone comes as an International Student, like me, immigration let us work for 20 hours a week and full time when we are on school breaks. However, Nico doesn’t have that status. He is a dependent of an international student or a foreign worker. And the word “dependant” its what makes things so complicated.
Why cant he work if he has a student permit?
Nico has a study permit, just as mine. But, as he is a dependant, that immediately disables him to work. In fact, all the permits at the bottom page have a space for annotations. That space is used by immigration to let Canada Services if you can work or not. Although, Nico doesn’t have any note which means he is not allowed to work. Therefore, Canada Services will not issue a Social Insurance Number which is needed to legally work in Canada.
We could go to immigration and apply for a work permit for Nico. However, that will not be a good idea, because as soon as he gets a work permit, he will stop being a dependant and he will be removed from the family group immediately. So, he will need to start the immigration process by himself, and the truth is, he doesn’t have enough points. Not even the minimum to get into the Express Entry.
Keeping the family group together
Turning 18 and not having your permanent residence (PR), adds a lot of stress to the situation. He is seen as an adult, who can work and pay for his stuff, request loans and credit cards and usually people do not understand why he is not working. But this is our reality. As grownup as he looks and feels, he still needs his parents for the immigration process and there is nothing to do about that.
Any immigration process that he starts by himself, will have the same effect, the immediate removal from the family group. Leaving him alone and with not enough points to start the Express Entry.
So, for now we just need to have some patience, try to help in any way we can and wait for the miracle day when we can have our Permanent Residence card in our hands.
